These terms do not supersede statutory rights under the Sale of Goods Acts but are designed to clarify the principles and procedures by which we operate. Every care has been taken to ensure that the descriptions and specifications are correct on this website. However, while the colours displayed are a close representation, slight variations in the actual goods may occur. All measurements given are approximate.
Making a Purchase We accept credit and debit card payment. You may also send your credit card information via phone, fax or post . No binding contract will exist between us until we have accepted your order. All goods are sold subject to availability, and can be placed on back order. If you wish to pay by cheque, please print off a copy of our order form and enter your required products and amounts and send to us. We will confirm your order and let you know how long it will take to arrive. We then ask you to send us a cheque made out to Thornback & Peel and send to Thornback & Peel, Studio W11, Cockpit Arts, Cockpit Yard, Northington St, London WC1N 2NP. Please write your cheque card number on the back of the cheque. Once we have received your payment we will send out your order by recorded delivery.
Credit Card Security Your order is processed by PayPal using 128-bit encryption. No credit card details are stored by us on our site.
Currency & Pricing All prices shown in this website are quoted in pounds sterling and are inclusive of VAT (credit cards sales will be charged in your local billing currency by your credit card provider). Data entry errors or other technical problems may result in inaccurate prices being shown. In such cases it is not required to honour this price. If you see any price you believe to be incorrect, please contact us so we can verify it for you.
Shipping/Carriage The final price quoted on the payments page is the price of the goods including delivery to the stated destination. These charges include carriage by UK Royal Mail or UK ParcelForce to both home and overseas destinations. As all our items are made to order please allow 30 days for items to be despatched unless a shorter time is especially requested and agreed. Our Postage and Packaging rates are displayed on our website and are subject to change without notice. However, once we have accepted your order we will not change the price that applies to such an order.
Duties and Local Taxes Purchasers are responsible for any duties and/or taxes levied at the point of entry into the destination country. A commercial invoice is provided with all goods shipped. You shall not be entitled to cancel your order on the basis of unforeseen duties or levies.
Resale You will not resell any goods or offer any goods for resale in any country.
Damage & Loss In Transit Occasionally, unfortunately, things do get lost or damaged in transit. If this happens with your shipment, please advise us and we will supply replacement goods as quickly as we can. However, since we never knowingly ship damaged goods we need your help to try to recover our costs from the carrier wherever possible. If you do receive damaged goods, please retain all relevant documentation so that an insurance claim can be made against the carrier's insurers. If you receive a battered parcel, note the fact on the delivery note, even before you open the package to examine the contents. If you are unable to open the damaged package in the presence of the carrier, make sure that you sign for it as 'Damaged package; goods not yet inspected' or similar to warn the carrier that a claim may be forthcoming. Whatever the circumstances, please contact us by email with as much detail of the damage or loss as you can provide, as soon after delivery as possible, so that we can arrange replacement goods and start following up the carriers. Please do NOT return damaged goods, unless and until requested to do so as this may incur additional costs unnecessarily.
Refunds and Exchanges We try at all times to please our customers. If you are not happy with a product, notify us within 5 days and return the goods to Attn: Web Returns, Thornback & Peel, Studio W11, Cockpit Arts, Cockpit Yard, Northington St, London WC1N 2NP. Items will be refunded or exchanged provided that you do not use the items, the items are in the same condition as when they arrived, and you take reasonable care to ensure the items are received by us and not damaged in transit. Post and Package costs are not refundable. We are not responsible for return postage or packages that do not reach us. Please ask at the Post office for a free certificate of postage. However in the event of the goods being faulty we will cover all costs for postage and either refund or exchange of goods. Please check your order carefully before sending.
Returns Policy Your rights to return goods are protected under the EU Distance Selling Directive which can be found at http://www.hmso.gov.uk/si/si2000/20002334.htm
Proof of Posting For your own protection, you are strongly advised to obtain a proof of posting, or shipping certificate from a courier, when returning goods whatever the reason for the return. Goods which are returned to us but are lost in shipping remain your responsibility. A proof of posting will assist you in tracking any shipment which is reported as lost, damaged, mislaid or otherwise undelivered/undeliverable.
Cancellation (applies to UK residents ONLY) UK residents (only) may cancel their contract to purchase goods by formally notifying us within a period of seven working days of delivery, provided that the goods are promptly returned to us at Thornback & Peel, Studio W11, Cockpit Arts, Cockpit Yard, Northington St, London WC1N 2NP. in 'as sold' condition with packaging unopened and seals unbroken, to arrive within fourteen days of your original receipt of the returned goods. In the event of cancellation under this provision a full refund, including shipping costs, will be given within thirty days of our receipt of the returned goods. Please note that refunds will be made using the same method as the original payment. (i.e.: a credit card purchase will be refunded through your credit card account). We may cancel an order for any item at any time before delivery.
Payment and Retention of Title Under normal circumstances, goods must be paid for prior to despatch. If, for any reason, goods are shipped prior to clearance of payments, title in the goods shipped belongs to Thornback & Peel until payment in full for the goods is received by us. Please note that on-line transactions are normally actioned automatically whilst you are on-line to the secure transaction server.
Confidentiality We undertake to exercise all reasonable precautions to keep information supplied to us by customers strictly confidential. We do not supply our 'mailing information' to third parties but do use it to advise our clients of goods and services we feel may be of interest to them, unless expressly instructed otherwise in writing. Information supplied to us may be stored on a computer system for our convenience, but will not be supplied to any outside agency. We prefer you to use the secure transaction services to make credit card transactions since this service is completely independent of our organisation and your credit card details are not divulged to us at any time. Applicable Law and Courts of Jurisdiction: All transactions undertaken through this website are governed by English Law and any legal actions arising out of such transactions shall be subject to the English Legal processes and under the jurisdiction of English Courts.

Mediation In the event of disagreement between Thornback & Peel and its clients which cannot be mutually resolved in a reasonable time period, the Institute of Directors (UK) may be asked by either party, subject to the agreement of the other party to the dispute, to appoint a mediator to settle the dispute before bringing the matter into the legal process. In this event, both parties agree to be bound by the decisions of such mediator and mediation process.
Errors Every effort is made to ensure that al the information provided on the Thornback & Peel website is correct at the time of going on line. If we discover an error relating to your order, we will contact you as soon as possible to advise you of the error and confirm that you still wish to proceed.
General No order is binding on you or Thornback & Peel until we have accepted it. You will own the items we supply you form the moment they are put in the hands of the postal service, or on payment in full of the price of the items and any delivery charge, which ever is later. These terms and conditions can not be varied by you or us unless made in writing and signed by both parties.
